Catholic nurse forced to participate in abortion, lawsuit filed

.- The Alliance Defense Fund (ADF) has filed a lawsuit on behalf of a Catholic nurse who was forced to participate in an abortion, despite voicing her moral objections. Catherina Cenzon-DeCarlo, a nurse at Mount Sinai Hospital in New York, was instructed to assist in a late second-trimester abortion for a woman 22 weeks into her pregnancy. The hospital had known of the nurse’s religious objections to abortion since she was hired in 2004. Cenzon-DeCarlo reminded her supervisors of her religious objections, but was told that if she did not participate, she would be charged with “insubordination and patient abandonment,” which could result in disciplinary action and the possible loss of her job and nursing license. Hospital officials told Cenzon-DeCarlo that the situation was an “emergency,” although evidence suggests that this was not the case. The hospital itself labeled the case as a “Category II,” meaning that the operation needed to take place within six hours. This would have allowed enough time to find another nurse without moral objections to assisting in the abortion, her lawyers said. Matt Bowman, legal counsel for the ADF, explained that the hospital could not legally have required the nurse to participate in the abortion even if the case had been a “Category I,” meaning that the patient required “immediate surgical intervention for life or limb threatening conditions.” Federal statutes prohibit recipients of federal health funds from requiring employees to perform abortions, Bowman told CNA. However, the evidence in the case suggested that the patient was not even at the “Category II” level, as the hospital had claimed. When the woman was brought into the room, Cenzon-DeCarlo observed no indications that the case was a medical emergency. The woman’s blood pressure was not at a crisis level, and standard procedures for patients in crisis had not been taken. Yet the nurse was still required to aid in the abortion. When CNA contacted Mount Sinai, officials refused to comment or explain why the nurse was asked to participate in the abortion. Officials stated that they would not comment because a lawsuit is pending. Now, the ADF has filed a lawsuit against Mount Sinai for violating Cenzon-DeCarlo’s rights of conscience. According to Bowman, this scenario is not unique. “We’re seeing more and more cases where pro-life health workers are facing requirements to assist in abortions against their rights of conscience,” he said. Earlier this month, President Obama promised that a “robust conscience clause” would be forthcoming, but critics are skeptical after his earlier decision to repeal conscience provisions put in place by the Bush administration. However, Bowman remains hopeful about the case. “We’re going to fight so that pro-life nurses are not forced to assist in abortions,” he said. “This is a battle we have to win.” Subscriber comments:

It is far better to obey God than men. When men advocate for murder of unborn innocents, it's completely appropriate to refuse. If more people had refused to cooperate with the slaughter of millions of people during the Holocaust, imagine how many lives would have been saved.

There's not enough information in this article. If this woman was brought to the hospital with an ectopic pregnancy (one where the fetus develops outside the womb), the fetus cannot be carried to full term. Period. The fetus/developing cells must be removed to save the mother's life. If the woman had suffered a rupture, she could bleed to death in a matter of hours.
If this was the situation and the nurse refused to participate, I side with the hospital. Shame on the nurse for refusing to help a critically injured woman in favor of a 22-week-old fetus that would not have survived the pregnancy anyway. By participating in the procedure, she saved a woman's life.

If she can't do the job and treat patients in a non discriminatory manner by treating all patients following professional guidelines, she needs to get out of the profession of nursing.

After the so-called "health care reform" legislation is passed by the US government, I doubt any doctor or nurse will be able to legally refuse to participate in abortion. At the very least we will all be paying for abortions with our tax money. It will be treated like any other procedure.
As for this particular nurse, I too would sue the hospital. They should not force her to choose between her job and her religious and moral beliefs. That said, if I were her I would have walked out and dared them to fire me.

Personally, I think this horrible violation of one's conscience is so offensive to many of us that if it continues, I can see a the US degrading into a literal (shooting) civil war with conservatives and Christians believers on one side the evil heathens and Pagans on the other side.
What will it be next? Forcing people to abort for population control?

By applying the principles of Catholic moral theology (principles of cooperation), the nurse is not considered morally responsible if she was forced to assist in the abortion. Her being compulsed to do so created an impediment to her will. More would need to be known about the actual circumstances---proximity to the violating act and how necessary her assistance was---to determine her moral responsibility. The person who forced the nurse is guilty of formal cooperation; this person is an accomplice (and morally responsible) even if he/she is miles away from the operating room.

I want to write and express my feelings to the administrator of this hospital. Does anyone know the address. I tried looking it up and they have so many different addresses to Mt. Sinai Hospital in New York. I cannot believe how abortions are tolerated in our country. Some the same people who make laws to protect animals see nothing wrong with slaughtering a baby. The slaughter has got to stop! We need to have reverence for "Life."

ddotsynurse, nurses should know that there is no such thing as a life saving abortion. Procedures have been legal to save the life of the mother (and where the death of the child can be foreseen) without directly attacking the child him/herself. You don't "save" the life of the mother by ripping the child apart, sucking the brains out, and/or by pouring chemicals. You treat the problem itself rather than partaking in terrorism against the child.

Some of the writers here really need to search all the articles on this story to get the full details. The nurse tried to beg out of assisting in this procedure but was told that it was a life saving abortion, only to find out after it had begun that it wasn't so. Also note that the Director of nursing prevented the manager oncall that day to call any other nurse to cover the case. Here is the thing from what I understand this hospital does uphold it's employees right to refuse to participate in procedures or experiments which violates their moral beliefs. Obviously the Director of nursing was acting independently of all hospital policy when she insisted that the nurse do the procedure. Even if she would claim that the doctor lied about the gravity of the patient's condition, she knows her staff and should have made provisions to release her from that situation. This is truly unfortunate as this is really not a reflection on the hospital but on the bullying director. I sincerely hope that she is terminated. I am willing to wager that Ms. DeCarlo is probably not the first nor the only nurse who has been bullied by this monster who btw. calls herself a nurse. She is really a disgrace to the meaning of the word nurse. As a nurse I truly empathize with this fellow nurse and I sincerely hope that she wins this case.

I agree. The abortion industry is pure and simple greed. It is possible, though, that the nurse was not aware that she could refuse until after performing the abortion. I had a Catholic friend-nurse at my school complaining to me about how she had to give advice to pregnant students, and she could not discourage them from abortions! She was a convert and hadn't realized she had any rights in this. I told her she should refuse to participate if she had to give advice to such students.

We should be careful not to judge this nurse too harshly. Maybe she is in trouble financially & had a moment of weakness because of a fear of losing her license, home, etc.. Peter denied Jesus out of fear, & Jesus did not condemn him... We don't know what she was dealing with, & I'm sure superiors were accusing her of abandoning her patient. Other nurses that say they would never do it may have been blessed with more graces or courage than this woman. Maybe God did not give her the courage needed because it was His will that this lawsuit & situation come to light in a very public case. Please don't condemn this poor woman! Pray for her!

I'm not catholic, but saw story on Fox and was looking for more info. It sounds to me, that the hospital was trying to either go after her personally, or see if with new president and congress, they could get away with setting presidents of forcing a pro-life personnel to do abortions. I actually suspect the latter. Why? They weren't going to just fire or discipline her, they were going to go after her license which would prevent her from getting another job. Once one prolife nurse gives in, they can use that to pressure others. Obviously, this isn't about "choice," but coersion to do things not allowed in God's Word. We all need to be in prayer for our country, for this nurse, and for ourselves that when faced with testing we will be strong thru Jesus.

This is what happens when materialism and comfort are loved more than human life, murder becomes justifiable. God have mercy on us, for we are so blind that we would chose to murder rather than to lose our possessions.

If you are Catholic you should always ask yourself how will any decision affect my salvation. I wish the nurse would of walked out that would have been the Catholic thing to do. A lawsuit will do nothing for the immortal soul.

In reading these posts, i see a loss of focus in many people. I see the term, "pro choice" used as an opposite to "pro life." For the life of me, I cannot understand why we do not call it what it is: Pro Life and Pro Death. If not, let's call it pro life and anti life -- Let's level the field and make our point to those who have come to worship double-speak. We must realize the hypnotic effect of verbiage manipulation in today's world.

I hope that in the future this nurse will be able to stand up for her faith and not sucomb to pressure. This is just the beginning of Right against Wrong...Life against Death. Let us all pray for the nurse, the hospital and its staff, the mother of the baby as well. We must pray, pray, pray. We must! If we don't, this holocaust of infant deaths will wipe out the American life. Our lives will be in jeopardy of arriving in Heaven as well. Don't judge this nurse. She might have needed her job and could lose her license regardless how we know that isn't right. Pray for her strength and that she was able to assist in maybe saving the mother's life. We need to pray for this nation and its leaders daily.

In my 45 years of nursing, I have refused to participate in murder of infants since I was a student nurse. No one could "force" me under any circumstances. I would have walked out. Finished business.

Pro-life health workers such us this nurse, need our prayers and encouragement. But they will not feel anything but isolated unless their pro-life communities back up their words with practical support such as funds to help in legal defence or when licences are revoked and jobs are lost. It is really tough to confront the possible loss of many years and financial sacrifice to train in these fields, not to mention the work of career and practice building. Alternative employment may be difficult to obtain. These workers have families to support and retirement funds to build. They are at the coal face of prolife medicine. I hope they find they are really supported.

Forcing pro life catholic nurses to asist in forcing death on innocent unborns is a total outrage!
Pro life Medical personnel should never have to go through this they should all be excused at all times from having to go through such a shocking procedure! Now what choice did the Catholic nurse have here? People are sick of the prochoice side forcing their choices on others such as the nurse here! The unborn gets no choice so why is choice always so slanted one way in favor of the aborting mother its just not right life aint just for pushy prochoicers that make life uncomfortable for say Catholic nurses The legislation has to protect the Pro LIFE side/ personnel too and not just KOWTOW to the pro abortionists as was so evident with this horrible event as above! simple as that!

can ONLY speak for nyc and this professional should have been informed of HER RIGHTS.
They can't even force you to "pull" the instruments for the trays,or set up the trays,wrap/sterilise the trays etc. etc. Way back in th 70s,i was pulled to the OR and that's the first thing I was TOLD by a permanent night shift RN. I was directly told that I don't have to touch a thing related to abortions,and at the time,night shift did prepare for the busy OR schedule and TIPs were being done in that sector,not in an outptient setting and TIP stood for "therapeutic interruption of pregnancy" What a load of nonsense as over at mt sinai,they easily could have gotten a replacement,a surgical resident,an ob/gyn etc that BELIEVES and SUPPORTS roe v wade. Nurse should have clocked out and filed complaints with any and all civil rights,equal employment etc.

Why does the term "choice" only apply to people who want to kill a pre-born child?
What about this nurse's CHOICE to NOT pariticipate in murder? Why was that not honored then same way a baby-killer's "choice" is? Very sad times we live in indeed. Hope she also sues for discrimination. BTW- Catholics are not the only Christians healthcare workers opposed to abortion. Additionally,there are many devout Jews & Muslims also opposed to it. But Catholic's do have the largest collective voice on the matter. In CT the state has forced Catholic hospitals to give morning after pills to rape victims. So much for seperation of church and state....

I am staunchly pro-choice, and believe utterly in women's right to choose. However, i feel so deeply for the nurse involved in this situation - nobody should EVER be put in a situation with their morals or belifs are jeopardised to keep a job, no matter WHAT those beliefs are. Everybody has the right to personal freedom, both to choose abortion and to not choose it. My thoughts are with her and i hope her soul recovers.

I am a simple person and perceive simple situations. When a sperm and an egg get together, there is a baby, no ifs, ands or buts about it. Simple greed is what drives someone to an abortion, either the mother or the doctors. I commend Catherina for her stand, but I think she should go look for a Catholic or Christian hospital where abortions are not done and mothers and babys are protected. Then she would not have to worry. I will light a candle for her at my church this week end and pray for the mother of the aborted baby.

Having been in a similar situation, if the nurse really believed what she says, she should have refused and let the chips fall where they may. There are too many needs for good nurses to let corner her into assisting. Not as noble as she writes, to me.vb52r

My brother was allowed to opt out of working SUndays for religious reasons, parents are allowed to opt out of vaccines for their children for religious reasons and my friend, a physicians assistant, is allowed to opt out of assisting for abortions - this hospital needs to get a clue. How about some "sensitivity" training for people of religious convictions? Employers are required to do sensitivity training on "tolerance" ...maybe they need to start including those with religious convictions so they can be "tolerated" with in their work place!
This issue really fries me! r-r-r-r!

The Nurse should have refused to take part in the killing of an unborn baby, no matter what the consequences!!! If she is truly anti-abortion, why did she commit the act? If she had been ordered to kill the baby moments after birth, would she have complied in order to save her job? She will probably make a lot of money in this lawsuit...too late for the baby though...and I know babies that have survived outside the womb even at 5 months into the pregnancy...too little, too late for that Nurse...

I am glad that the lawsuit is being filed, but she still chose to participate even if her job was being threatened. Hasn't she automatically excommunicated herself from the Church? She may not be aware of this. I don't want to sound cold-hearted, but that would have nothing to do with whether that excommunication exists or not. I am not sure if the person has to be aware of the coming excommunication to be excommunicated or not.

She helped with the abortion? She should have refused and then filed the laswsuit after the consequences were implemented. Then she wouldnt have the death of this baby on her conscience. Good for her that she is still going to fight it in court. Thank you ADF for helping her. I would feel the same as her if this Obama health plan passes and my tax dollars were used to pay for abortions.

What we need is a Church that offers shelter to those who are trying to escape TODAY'S EVILS. The Church needs to offer employment in Catholic Hospitals and institutions to those who are objecting to the growing evil in soceity. If we have to just employ Catholics who, for example, aren't going to demand contraceptive coverage so be it. The time has come for us to remove ourselves from an increasingly evil society. Bishops have to develop the infrastucture (shelter) so we can do so. We can't fight this, we can ONLY REMOVE OURSELVES FROM IT.

Dear Lord ,God and Savior help us to act in the power of the Holy Spirit,so that your will be done and a holy and pure love be in all our actions. Keep us from all sin and near occasion for sin. Protect the innocent from the sins of those who would threaten those who disagree with them,to participate in their acts of abomination,as if it were some kind of a professional standard,of a commitment to some kind of a necessary evil. No evil is ever necessary and it should not be mandatory,so a greater power for destruction may prevail.
May the health care worker always be in a position to carry out the necessary benefit for others,and not some proposed questionable evil. May no harm be done and may the greater good be a desire and a commitment to act,in a sincere love for others,and an overwhelming desire to support life saving professional healthcare outcomes. Abortion is not one of these desired outcomes. Abortion is not of God and it is not the will of God. The willfulness of those acting according to their own will is the will that makes abortion necessary. Save us from committing this horrible sin,in the name of Jesus and may no one be forced to participate in an abortion. Amen.

if every catholic nurse or doctor sticks together and fights to end being forced to participate in abortion....then we will win....they need to be strong and not give in....this is going to be a long fight....I thank the nurse who has the lawsuit....when my girls grow up and if they become nurses then I will not have to worry about these situations....Thanks you Mrs. Bowman....

While it is awful that this has had to happen, I am pleased to see that a legal stand is being taken. My wife is a L&D nurse and we have had many conversations about how to handle such a situation if she were put into it. Not only abortion, but tubals and any other sterilization procedure. Clearly, forcing someone to do this against their religion and to put their immortal soul in jeopardy is a violation of our 1st amendment rights. Isn't the president supposed to defend and uphold the constitution?

My guess is that this will come down to the often used and bedrock clause in the culture of death handbook as a case of "the physical and/or mental health of the mother" being at stake. That way all other considerations go out the window.
After all we have to remember at this point abortion is a "right" the Supreme Court bestowed on "mothers". However, I have another guess. Nurse Catherina is no doubt a Christian but had she had refused on the same grounds as a Muslim the hospital would have taken a different approach to her request. Do I have a point?

I really do not understand why a woman who wants to kill her baby has the "right to choose" and a nurse does not have the "right to choose" not to take part in the killing. At the time my mother gave birth to me, and when I had my children, to have a baby was a "happy event."
There were thankfully no abortion clinics, and no unwanted babies. All the doctors were caring and so were all the nurses. Babies were regarded as human beings, born or unborn. ADD A COMMENT (Your e-mail will NOT be published):
